DMCA Copyright Policy

WAVE Online, LLC respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. This page explains how to submit takedown notices and counter-notices, and our repeat-infringer policy.
Designated Copyright Agent

Takedown notice requirements (17 U.S.C. § 512(c)(3))
A valid takedown notice must include:
- Physical or electronic signature of the copyright owner or authorized agent
- Identification of the copyrighted work claimed to be infringed
- Identification of the allegedly infringing material with sufficient detail to locate it (URL preferred)
- Your contact information (name, address, phone, email)
- A statement of good-faith belief that the use is not authorized by the copyright owner, its agent, or the law
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on the copyright owner's behalf
Service-level commitment
WAVE processes valid takedown notices within 24 hours. Automated acknowledgment within 1 hour. We notify the affected user, remove or disable access to the material, and forward your notice to them.
Counter-notice (17 U.S.C. § 512(g))
If you believe content was removed in error, you may submit a counter-notice. After receipt of a valid counter-notice, WAVE will restore access in 10–14 business days unless the original complainant files suit and provides notice. Submit counter-notices to the DMCA agent above.
A valid counter-notice must include all elements required by 17 U.S.C. § 512(g)(3), including consent to jurisdiction in your federal judicial district (or, if outside the U.S., the Southern District of New York).
Repeat-infringer policy
Per Section 512(i), WAVE maintains a 3-strike repeat-infringer policy. Strikes accumulate across all WAVE products tied to a user account or organization:
- Strike 1: Warning + content removal + 7-day acknowledgment requirement
- Strike 2: 30-day suspension of upload + monetization features
- Strike 3: Permanent termination of account; revocation of API keys; 12-month ban from creating new accounts at the same organization
Misrepresentation liability (17 U.S.C. § 512(f))
Knowingly material misrepresentation in a takedown notice or counter-notice subjects the sender to liability for damages, costs, and attorneys' fees. Submit notices in good faith only.
